How do Spain’s confusing online gambling laws compare to the UK?

Spain’s online gambling laws are far more complicated compared to the UK’s clear and centralized system. In the UK, the Gambling Act of 2005 provides a unified framework, with the UK Gambling Commission (UKGC) overseeing all online gambling activities. This centralized approach ensures transparency, consumer protection, and ease of navigation for operators and players.

 

In contrast, Spain operates under a dual regulatory framework, with national licensing handled by the Dirección General de Ordenación del Juego (DGOJ) and additional regional regulations. This fragmented approach requires operators to obtain multiple licenses to operate across different regions, creating confusion and stifling market growth.

 

Advertising rules further highlight the disparity. The UK Advertising Standards Authority (ASA) enforces clear guidelines, focusing on preventing gambling ads from targeting minors and vulnerable individuals. Meanwhile, Spain’s 2021 Royal Decree restricts gambling advertisements to the 1 am to 5 am time slot, causing significant challenges for operators in reaching audiences effectively.

 

Overall, while the UK’s system promotes transparency and growth, Spain’s overly complex regulations hinder the online gambling market, creating difficulties for operators and limited protections for consumers.
