Justices let federal horse racing law sprint on as legal battle continues
The U.S. Supreme Court has decided to temporarily uphold the federal law governing the integrity and safety of horse racing, despite ongoing legal challenges questioning its constitutionality. Enacted in 2020, the law aims to unify safety and anti-doping regulations in horse racing, granting oversight to the Horseracing Integrity and Safety Authority (HISA) under the supervision of the Federal Trade Commission. However, the 5th Circuit Court of Appeals ruled that the law violates the constitutional nondelegation doctrine by assigning regulatory power to a private entity. The Supreme Court’s decision allows HISA to continue regulating horse racing while the legal battle continues.
