Maryland Law Targets Revenge Porn, Deepfakes

Maryland’s new law, Senate Bill 360 (Chapter 219), effective July 1, 2025, expands existing revenge porn protections to include “visual representations”—defined as both real and AI-generated intimate images indistinguishable to ordinary observers. Victims can now file civil suits against individuals who distribute non-consensual sexual or intimate content, including deepfakes, and recover damages including attorney fees. The bill, sponsored by Sen. Katie Fry Hester, passed unanimously in both legislative chambers earlier in 2025. It was one of several bills addressing revenge porn and deepfakes, and aligns Maryland with federal efforts like the TAKE IT DOWN Act. The law is intended to modernize protections against emerging digital abuses and reduce barriers for survivors seeking justice.
