Rightsholders applaud federal court’s anti-piracy ruling
Canadian media and entertainment rightsholders have welcomed a Federal Court ruling that significantly expands the country’s ability to block online piracy services. The decision introduces a broader “omnibus” approach that allows blocking measures to follow piracy operations even when they change domains, brands or technical infrastructure to avoid enforcement.
Previously, Canadian blocking orders generally focused on specifically identified pirate services and domains. This created difficulties because illegal streaming operators could quickly move to new domains or rebrand their platforms after being blocked. The new ruling makes this process more flexible by allowing additional infringing platforms to be incorporated into enforcement without requiring the same level of repeated court intervention.
The Federal Court’s approach is particularly significant because the order can cover not only alternative domains associated with existing pirate brands but also similarly infringing services operating under different names. This makes it harder for operators to circumvent blocking measures simply by launching replacement websites or changing their identities.
Canadian rightsholders, including major broadcasters and media companies, view the decision as an important improvement in copyright enforcement. Quebecor welcomed the ruling, arguing that faster and more adaptable blocking mechanisms will help protect licensed content and Canada’s wider creative industries.
The ruling builds on Canada’s increasing use of dynamic blocking injunctions against illegal streaming. Existing Federal Court orders already allow Canadian ISPs to disable access to unauthorized streams of major sporting events, including the NHL, NBA, Premier League, MLB, UFC and FIFA World Cup.
Overall, the decision strengthens the position of Canadian rightsholders by making site blocking more responsive to the constantly changing structure of online piracy networks. It also represents another step toward treating dynamic and adaptable blocking orders as a central tool in Canada’s fight against digital piracy.
